The Hereditary Claim

The Claim of Right affirms the lawful continuity of the Royal House of Stuart from King Robert the Bruce and King James V of Scotland, through Francis Stuart, 5th Earl of Bothwell — whose blood and title endure unattainted by any lawful forfeiture.

Though the Act of Settlement 1701 politically excluded the Catholic heirs of the Stuart line, no act of Parliament could ever lawfully extinguish their descent in blood. By divine and natural law, the rightful succession remains unbroken.

This claim seeks not conquest but reconciliation — a call for remembrance, truth, and moral governance. The Stuart Crown rises not to divide the people, but to heal the nation through justice, faith, and restoration.


The Scottish Hereditary Claim

THE CLAIM OF RIGHT
By James Robert-Warwick Stuart, Heir of the House of Stuart, King of Scots by Blood, Right and Restoration

IN THE NAME OF GOD ALMIGHTY, THE SOVEREIGN MAKER OF NATIONS AND ORDAINER OF KINGS:

Let it be written and known to all peoples, governments and institutions that I, James Robert-Warwick Stuart, do now assert and proclaim, under solemn oath and blood-sealed right, the lawful and moral return of the Stuart Crown.

This is not a usurpation, nor a rebellion — but the lawful continuation of heritable right descended from the Royal Houses of Europe, Scotland and Jerusalem. Through the passage of time the line was hidden beneath a SOVEREIGN VEIL, yet not destroyed.

WHEREAS the abdication of JAMES II and the exclusion of his Catholic heirs was contrary to law and divine order; and WHEREAS the descendants of MARY and JAMES STUART were denied their birthright through acts of political treason against the Crown of Scotland.

THEREFORE we rise to restore memory and justice — to lift the veil, to set the record straight, and to serve in truth.

  • Lineal Descent: Unbroken from King Robert the Bruce, King James V and Francis Stuart, 5th Earl of Bothwell.
  • Unlawful Exclusion: Political disbarment under the Act of Settlement 1701 without lawful extinction of blood.
  • Civic Recognition: Crowned in symbolic rite upon Scottish soil in accordance with the Declaration of Arbroath.
  • Moral Legitimacy: Suffering and service borne in exile for the restoration of truth and justice.

WHEREFORE I assert my rightful claim to the name, title and duties of King of Scots, under Providence alone, and call upon the people, the government, the international community and the Church to witness this declaration.

⚜ The Bothwell Declaration ⚜

A Royal Proclamation by His Majesty James IV of England and IX of Scotland — Earl of Bothwell, Defender of the Ancient Line of Christian Kings.

WHEREAS the succession of the Scottish Crown was obscured since 1688; and WHEREAS the line of King James V endured through John Stewart, son of King James V, and father to the Earl of Bothwell, and through the maternal and last survivor of his line, The Lady Helen Stewart, which through the passage of time, sealed and unified through sacred marriages with the Provincial Kingdom of Ireland and the Princes of Carberry, remains unattainted and unbroken; therefore, under the authority of Providence alone, do I proclaim this Bothwell Decree:

  1. Article I. The foreign title Duke of Rothesay is abolished within the de jure Scottish Crown.
  2. Article II. The ancient dignity of Earl of Bothwell is lawfully restored; the historic attainder is void in posterity.
  3. Article III. The title Lord or Lady Stuart of Bothwell shall designate the Heir Apparent of the de jure Crown.
  4. Article IV. The office of Earl of Bothwell carries sacred obligation to serve and defend the people of Scotland, in the absence of the Legitimate Line of James VI, extinguished with the death of Henry Benedict Stuart in Rome.
  5. Article V. All proclamations issued by the bearer of this title hold royal authority within the de jure Crown until lawful succession renders otherwise.
  6. Article VI. That the Kingdom of Scotland, its Crown, its succession and its choice of Government, is no longer under the jurisdiction of Westminster, nor can it ever be held as such, for that prerogative of Scottish sovereignty is for the Scottish people to freely decide, alone.

Let it be known throughout the realm that the Crown is not a bauble of vanity but a chain of service; he who bears it must do so in blood, pain and truth — by the will of Heaven and right of heritage. Soe Helpe Me Gode.
